1. Who we are

This website, defensio.technology (the “Site”), is operated by Fidem S.r.l., with registered office at Via Don G. B. Tessari 14/A, 37030 Lavagno (VR), Italy, VAT no. IT04438280234 (“Fidem”, “we”).

For questions about the Site or these terms, please use our contact page or the corporate channels published on fidemsrl.it.

2. Scope of these terms

These terms govern the use of this Site only. The Site is a product-information website for the Defensio product family: it presents products and services, but it does not sell anything directly.

These terms are not the contract for any Defensio product or service:

  • Defensio SECaaS and Identity Shield are purchased online through the dedicated portal app.defensio.technology, under the contractual terms presented there at signup;
  • Defensio Sensor, SOC and XT are contracted directly with Fidem under signed agreements.

If you have a product contract with Fidem, that contract — not these terms — governs the products and services it covers.

By using the Site you accept these terms. If you do not accept them, please do not use the Site.

3. Intellectual property

The content of the Site — including text, images, graphics, layout and documentation — belongs to Fidem S.r.l. or is used under licence. Fidem® and Defensio® are registered trademarks of Fidem S.r.l.

Neither these terms nor your use of the Site grant you any licence or right in the content or the trademarks. You may view, download and print pages of the Site for personal, informational, non-commercial use, provided you keep all proprietary notices intact. Any other use requires our prior written consent.

4. Acceptable use

You agree to use the Site lawfully and, in particular, not to:

  • attack, probe or attempt to gain unauthorised access to the Site or to the infrastructure that serves it;
  • scrape or harvest content at a scale or frequency that burdens the Site, or use automated tools to that effect;
  • disrupt, or attempt to disrupt, the availability or integrity of the Site;
  • use the Site to distribute malicious code or unlawful content.

These terms do not authorise security testing of the Site. If you believe you have found a vulnerability, please report it responsibly as described on our security page.

5. Product information

The content of the Site is provided for general information. It may change at any time without notice, and it does not constitute a contractual offer, a warranty or professional advice of any kind. Technical characteristics, service levels and all other product specifications are defined exclusively in the applicable contracts.

6. Links to other sites

The Site links to other websites, including sites operated by Fidem or relating to its affiliated businesses — such as fidemsrl.it (corporate site), app.defensio.technology (purchase portal) and fidemcybersecurity.com (international consulting) — as well as possible third-party sites.

Each linked site is governed by its own terms and its own privacy documentation. We are not responsible for the content of third-party sites, and a link does not imply endorsement.

7. Warranties and liability

The Site is provided “as is” and “as available”. To the maximum extent permitted by applicable law, Fidem does not warrant that the Site will be uninterrupted, error-free or fit for a particular purpose, and accepts no liability for damages arising from the use of the Site or from reliance on its content.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited under Italian law — including liability for wilful misconduct (dolo) or gross negligence (colpa grave) — and nothing in these terms affects the mandatory rights of consumers.

8. Privacy and cookies

Personal data collected through the Site is processed in accordance with the privacy policy of Fidem S.r.l., available at fidemcybersecurity.com/privacy-policy. The use of cookies and similar tools on this Site is described in the Cookie Policy, which complements the privacy policy.

9. Changes to these terms

We may update these terms from time to time. The current version, with its effective date, is always published on this page. Continued use of the Site after a change takes effect constitutes acceptance of the updated terms.

10. Governing law and jurisdiction

These terms are governed by Italian law. Any dispute arising from these terms or from the use of the Site is subject to the exclusive jurisdiction of the courts of Verona, Italy — without prejudice to mandatory consumer protections: if you access the Site as a consumer, you retain the forum and the rights granted to you by applicable law.

If any provision of these terms is held invalid, the remaining provisions remain fully effective.

11. Language and effective date

These terms are drawn up in English, with an Italian courtesy translation available on the Italian pages of the Site. In case of conflict or doubt of interpretation, the English version prevails, without prejudice to mandatory rules on the interpretation of consumer terms.
